Incorporating Your Business – Now What Should You Name It?

One of the most frequent questions we’re asked when it comes to forming a business entity is – “What should I call it?” And with few exceptions, the answer is pretty simple – “Whatever you’d like.”

Each state has certain naming regulations that must be observed. For example, if the entity is a limited liability company then it should end in “LLC” or “Limited Liability Company.” And each state also requires that the name used is unique for that state so it doesn’t create confusion among the public. But outside these specifics (and a few other common sense ones), the name used is completely up to the organizer.

But there are some practical considerations you should pay attention to when you’re selecting an entity name. It’s usually a good idea to have the name be consistent with the objectives you have for the entity. If you’re seeking privacy then using your name as part of the business entity is an obvious no-no. If you’re hoping to build the name as a brand then you’ll want to make it consistent with the image you’re creating.

And don’t forget that the name of an entity can easily be changed so if you don’t like what you’ve got, just file the necessary paperwork to change it. The cost is typically minimal. You can also register trade names associated with the business entity so it can have multiple “personalities” (similar to an author using a pen name).

So when it comes time to name your entity, be creative in a common sense sort of way. Follow the state’s rules and check to make sure the name is unique. Then whip out the brainstorm brawn and name away!
